Welcome to Fixaars. These Terms & Conditions ("Terms") govern your use of the Fixaars website, mobile application, and all related services ("Platform"). By accessing, downloading, or using the Platform, you agree to be bound by these Terms.

If you do not agree, you must stop using the Platform immediately.

A. About the Fixaars Platform

Fixaars Inc is a digital marketplace that connects individuals seeking handyman or home repair services ("Users") with independent contractors ("Service Providers").

Fixaars Inc:

  • Does NOT provide handyman services
  • Does NOT employ or supervise Service Providers
  • Does NOT guarantee the skills, qualifications, or background of Providers
  • Is NOT a party to any agreement between Users and Providers

The Platform strictly facilitates communication and booking.

B. Eligibility

To use Fixaars, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter a binding contract
  • Provide accurate and truthful registration information

Fixaars Inc may suspend or terminate access for any reason, including fraud, incomplete data, or policy violations.

C. User Responsibilities

Users agree to:

  • Provide accurate information and maintain updated account details
  • Use the Platform only for lawful purposes
  • Treat Service Providers and staff respectfully
  • Be available at the scheduled appointment time

Avoid:

  • False bookings
  • Fraudulent or abusive behavior
  • Harassment
  • Circumventing platform fees

Users understand Fixaars Inc is not responsible for services performed.

D. Service Provider Responsibilities

Providers ("Fixers") agree to:

  • Perform services professionally, safely, and on time
  • Maintain required licenses, permits, and certifications
  • Supply their own tools and equipment
  • Follow applicable laws and industry standards
  • Comply with all Fixaars policies

Fixaars may remove or suspend Providers for violations or repeated customer complaints.

E. Payments & Fees
  • All payments on Fixaars are processed through secure third-party payment providers (e.g., Stripe, PayPal).
  • Fixaars Inc does not store credit card or bank details.
  • Users agree to pay the total cost shown before confirming a booking.
  • Providers agree to pay service or platform fees as outlined in the Provider Agreement.

Refunds, if available, follow Fixaars Inc's Refund Policy.

Fixaars is not responsible for third-party processing delays or failures.

F. Cancellations & Rescheduling

Users may cancel or reschedule through the Platform:

≥ 12 hours before appointment No fee
< 12 hours before appointment Late cancellation fee may apply

Provider-initiated cancellations allow Users to rebook at no cost.

Repeated cancellations may lead to account restrictions.

G. Platform Role Disclaimer

Fixaars Inc:

  • Does not perform or supervise handyman work
  • Is not liable for Provider misconduct, damages, or injuries
  • Does not verify Provider identity, skills, or background unless explicitly stated
  • Is not responsible for disputes between Users and Providers

All interactions occur at the User's and Provider's own risk.

H. Limitation of Liability

To the fullest extent permitted by law:

Fixaars Inc is not liable for:

  • Property damage
  • Bodily injury
  • Loss of income
  • Fraud or theft
  • Poor workmanship
  • Missed appointments
  • Indirect or consequential damages

Your sole remedy is to stop using the Platform.

I. Third-Party Services

The Platform may integrate with:

  • Payment processors
  • Mapping/location services
  • Analytics providers
  • Customer support tools

Fixaars Inc is not responsible for third-party privacy practices or service availability.

J. Apple App Store Requirements (iOS)

If you downloaded the app via Apple iOS:

  • These Terms are between you and Fixaars Inc, not Apple
  • Apple is not responsible for the app or its content
  • Apple has no obligation to provide support
  • Apple is not liable for claims, refunds, or legal issues

Users must comply with Apple Media Services Terms & Conditions.

K. Google Play Store Requirements (Android)

If you downloaded the app via Google Play:

  • Google is not responsible for app functionality or issues
  • Users must comply with Google Play Terms of Service
L. Modifications

Fixaars Inc may:

  • Update features
  • Change or suspend Platform functionality
  • Revise these Terms at any time

Updates become effective immediately upon posting.

Continued use constitutes acceptance of the new Terms.

M. Termination

Fixaars Inc may terminate or suspend accounts for:

  • Misconduct
  • Fraud
  • Abuse or harassment
  • Illegal activities
  • Repeated cancellations

Users may delete their account via settings or by contacting support.

N. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, USA. Any legal disputes must be resolved in Virginia courts.
